2. LEARNING OUTCOMES

Learning Outcomes

1) The aim of the courses ENVIRONMENTAL LAW I & ENVIRONMENTAL LAW II-INTRODUCTION TO PUBLIC WORKS LAW (3rd and 9th semester, respectively) is to provide students with the basic understanding, principles, tools, institutions and procedures of environmental law (international, EU and domestic) using case-studies and focusing on implementation issues of domestic environmental law. Additionally, the aim of the course ENVIRONMENTAL LAW II-INTRODUCTION TO PUBLIC WORKS LAW is to provide students with the basic understanding, principles and procedures of awarding public works execution.

More specifically, the course ENVIRONMENTAL LAW I of 3rd semester will provide students with the basic background of International and European environmental law, in order to familiarize them with these particular branches of law and in order to understand the significant impact of these branches on domestic environmental legal issues.

Specific attention is given to the interdisciplinary character of environmental law as well as its dependence on technology.

2) Upon successful completion of this course students will be able to:

  • Identify the object, the purpose, the sources and the types of environmental law, its historical evolution and levels (international, EU and national)
  • Distinguish the tools and mechanisms between direct and indirect intervention of the State in the field of environmental protection
  • Revoke the general principles and basic institutions and tools of International Environmental Law as well as the basic concepts, principles, institutions, procedures and tools of EU law in key areas of environmental protection in EU with emphasis on its impact on domestic environental law
  • Gain a basic knowledge of the European Court of Justice (ECJ) case law and its impact on environmental legislation
  • Explain the concept of environmental risk, its assessment and management through implementation examples
  • Correlates international and EU legal texts (international conventions, regulations, directives, court judgements, etc.) regarding Environmental Protection
  • Acquire the necessary background to attaint the second part of the course in 9th semester (ENVIRONMENTAL LAW II-INTRODUCTION TO PUBLIC WORKS LAW) as regards the sustainable development, domestic environmental law and relevant implementation issues.

3. COURSE SYLLABUS

  1. Introduction to Law. Basic categories of Law. Basic notions of public and private law, of public international law and of European Union (EU) Law. The role of legislation and case law.
  2. Objectives, main purpose, characteristics and branches of Environmental Law (International, EU, national). Environmental law and other related branches of law. Sources and historical development of Environmental Law. Levels of Environmental Law.
  3. Hard law and soft law environmental regulation. Tools and mechanisms of direct and indirect State intervention in the field of Environmental Law.
  4. International environmental law. Historical evolution. General principles and international agreements.
  5. Key international environmental conventions, focusing on the issues of Biological Diversity, climate change and landscape.
  6. Environmental protection in EU law. Historical evolution. Sources and principles of EU environmental law.  The role of European Court of Justice (ECJ) in the protection of the environment – Highlights of ECJ Judgments
  7. Major areas of environmental policy (climate change - industrial emissions and accidents - environmental impact assessment)
  8. Waste management – biodiversity protection, Habitats conservation-Natura 2000 network - water protection and management
  9. Horizontal environmental EU directives (right to information - integrated pollution prevention and control - environmental liability)
  10. The role of case law in EU environmental law - representative judgments of EU Court of Justice (CJEU)
  11. Examples of indirect State intervention tools (eco-label, EU eco-management and audit system-EMAS)
  12. The concept of environmental risk - risk assessment tools – risk management
  13. Risk management examples: genetically modified organisms, exposure to electromagnetic radiation, exposure to chemicals
